Who is Zest Development?

Zest is an Augmented Reality App that allows user to attach messages to real-world objects. It is designed to discuss objects of shared interest with users that are also seeing it, will see it, is close to it, or will be close to it.

Zest App is being developed by Zest Development, Belarus.

Zest is a service provided to you by Zest Development if you agree to install and launch Zest App.

This is the Privacy Policy for Zest.

Zest is a service for creating, viewing, and sharing content. When you use these services, you’ll share some information with us. So we want to be upfront about the information we collect, how we use it, whom we share it with, and the choices we give you to control, access, and update your information.

There are three basic categories of information we collect:

Nature of Social Media Content Created With Zest App

As a user of Zest App, you will be able to create and view messages attached to objects that are content of Zest as a Social Media App. Messages attached to object consist of message text, message author information, object preview image, object recognition data generated from one or multiple object photo similarities, object GPS coordinates data, creation date and time. When creating Zest content, you expose a combination of those to potentially unlimited audience, and take responsibility for doing so.

Attaching messages to objects using Zest App follows regulations applicable to making photos of objects. Attaching messages to people using Zest App is not allowed.

You’re allowed to attach messages to objects that belong to other person or company. However, you must be allowed to publish a photo and GPS-coordinates of such an object in combination with information you provide in your message by your local regulations to do so.

Data You Provide To Us

We receive and store Data that you provide to us when you create an account and use our Consumer Service. When you create an account, we may collect your full name, email address, phone number, birthday, gender, and where applicable, your Facebook or Google username and other Data if you create an account using your third party log-in credentials (please see “Data Received From Third Parties” below). As you interact with us and use our Consumer Service, we may also collect other Data that you directly provide to us, which may include pictures that you choose to upload to your account, who you follow, comments, your likes  and any other Data that you volunteer to us.

Data Collected When You Use Our Consumer Service

When you use our services, we collect information about your activity and how you’ve used app.

If you use our Apps and have enabled background location services in our Apps, you have permitted us to collect the above Data about you in the background even when you do not have the Apps open (as permitted by your device settings). You may turn off location services at any time by going to your device settings and toggling off background location. For more information about location, please see “Determining and Sharing Location” below.

Data Received From Third Parties

We may receive Data about you from third parties. If you created your account using your Google, Twitter or Facebook account profile, we may receive certain information from these companies, such as your first name, last name, gender, birthday, email address and your Google, Twitter or Facebook ID

How We Use Information

We may also store or use information locally on your device. For example, we may store information as local cache so that you can open the app and view content faster

Protection Of Our Rights

We may use your Data to protect the rights, property or safety of Zest, the Consumer Service, our users and employees, or any third party. For example, we may use your Data if we need to enforce or apply our Terms of Service or Policies

How We Share Information

We may also share with third parties—such as advertisers—aggregated, non-personally identifiable, or de-identified information/

Determining and Sharing Location

Some features and functionality in our App may require that you provide your location. If you have your location services turned on, whenever you open and use or interact with our App (e.g. open the App  or make a ZestMark) on your mobile device, we collect and use your location data from your mobile device (e.g., latitude and longitude) to tailor the Consumer Service to your current location (i.e. we’ll show you a list of nearby ZestMarks). We will only process your location data with your permission. If you have background location data turned on by granting us permission through your device’s location settings and in your privacy settings, we will, from time to time, obtain your device’s location even if you are not directly interacting with the Apps. Other than in an anonymized, pseudonymized or aggregated form, your location is never shared with others, except with your consent or as permitted under this Privacy Policy.

PII Retention

The criteria for determining the duration for which we will keep your PII (Personally Identifiable Information) are as follows: we will retain copies of your PII only for as long as is necessary in connection with the purposes set out in this Privacy Policy, unless applicable law requires a longer retention period. In addition, we may retain your PII for the duration of any period necessary to establish, exercise or defend any legal rights

How do I Delete My Data?

You may also delete your account at any time. If you delete your account, your profile will be removed from the Consumer Service, and you will no longer be able to access such Data. We may not be able to restore your account once it has been deleted. Deletion of your account may not be immediate. Residual copies of your Data or ZestMarks may remain on backup media for a short period of time thereafter. Additionally, we may store certain Data that does not directly identify you, in our internal systems. We may also retain Data as required by applicable law and we will not delete any Data that , has already been anonymized.

Security

We use industry standard physical, technical, and logical security measures to protect your Data. We endeavor to safeguard your Data to ensure that it is kept secure. However, we cannot guarantee the security of Data in an account from unauthorized entry or use, hardware or software failure, and other factors.

Your account is associated to an email address that you have chosen (directly or through other Social Media accounts), and its security depends of security of your email password. If you use the Consumer Service on public or shared networks (e.g. public wifi), we cannot ensure the security of your account.

Users Outside the United States

Our App and all of our data, including your Data, are hosted on servers in the United States. If you are using or accessing the Consumer Services or Enterprise Services from outside of the United States, your Data will be transferred to, processed and stored in the United States. As a result, United States federal and state governments, courts, or law enforcement or regulatory agencies may be able to obtain your Data through laws applicable in the United States. United States laws may not offer the same privacy protections as the law of your jurisdiction.

Children under 13

Our services are not intended for—and we don’t direct them to—anyone under 13. And that’s why we do not knowingly collect personal information from anyone under 13.

Beta Testing

Zest App is currently in its Beta Testing stage. By using Zest in current development stage you agree that Zest App in some particular cases can function not the way you expect it to function, and Zest Development can not take responsibility for all those particular cases. Please use Zest App with caution in use cases that involve your PII or information that is sensible for your or other people or can possibly compromise your privacy and security, or other people privacy and security.

Content you view or create using current version of Zest can be modified or removed in later versions of Zest.

We may change this Privacy Policy from time to time. But when we do, we’ll let you know one way or another. Sometimes, we’ll let you know by revising the date at the top of the Privacy Policy that’s available on our website and mobile application. Other times, we may provide you with additional notice (such as adding a statement to our websites’ homepages or providing you with an in-app notification).
